Terms of Service

Welcome to Rezonect ("Rezonect", "we", "us", "our"). These Terms of Service ("Terms") govern your access to and use of the Rezonect mobile application and all related services (collectively, the "Services").

By creating an account or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

You must be at least 16 years old to create an account or use the Services. We do not knowingly permit anyone under 16 to register. If we discover that a user is under 16, we will terminate their account without notice.

By using the Services, you represent and warrant that you are at least 16 years of age, and that you have the legal capacity to agree to these Terms.

• Share your current emotional state ("emotion") with intensity levels, with close friends and family ("your Circle")
• View friends' current emotions on an interactive Circle visualization in real time
• Post "Moments" — text, photo, or video content optionally tied to your current emotion. Moments (including their descriptions and images) are visible only to users within your connection circle; they are not publicly accessible
• Send and receive emoji reactions ("Vibe Reactions") to friends' emotions
• Manage friend connections (send/accept/remove friend requests, block users)
• Chat with friends via real-time messaging powered by GetStream (see Section 8)
• Share your emotional journey over time with selected friends
• Receive push notifications about activity in your network
• Temporarily pause emotion sharing ("Emotional Break")
• Connect with friends via QR code

• Is unlawful, defamatory, harassing, threatening, or abusive;
• Constitutes hate speech or incites violence or discrimination;
• Contains nudity, pornography, or sexually explicit material;
• Exploits or harms minors in any way;
• Promotes or glorifies self-harm or suicide;
• Infringes the intellectual property rights of any third party;
• Contains malware, viruses, or harmful code;
• Is false, misleading, or deceptive;
• Constitutes spam, advertising, or unsolicited commercial communication.

You agree not to:

• Use the Services for any unlawful purpose;
• Access or attempt to access other users' accounts without their permission;
• Use automated tools, bots, scrapers, or crawlers to extract data from the Services;
• Attempt to reverse engineer, decompile, or extract the source code of the application;
• Interfere with or disrupt the integrity or performance of the Services;
• Circumvent any content-filtering or security measures;
• Create fake accounts or use the Services under a false identity;
• Use the Services to monitor, stalk, harass, or intimidate other users;
• Use the Services for commercial or business purposes without our prior written consent.

The Services integrate with third-party providers to deliver certain functionality. Your use of those features is also subject to those providers' terms:

• Firebase Cloud Messaging (Google): push notifications
• Amplitude: anonymous usage analytics — no personally identifiable information (name, email, phone number) is sent; IP address tracking is disabled; data is processed on EU servers only
• Sentry: crash and error reporting
• ipinfo.io: IP-based geolocation for security and fraud prevention

We are not responsible for the practices or content of third-party services.

Real-time messaging within Rezonect is powered by GetStream, Inc. ("Stream"). By using the chat features within Rezonect, you acknowledge and agree that:

• Chat messages and media are processed and stored by Stream on their infrastructure;
• Stream's Terms of Service and Privacy Policy apply to your chat data in addition to these Terms;
• We have limited ability to moderate or retrieve chat content beyond what Stream makes available to us;
• We are not liable for any loss, exposure, or misuse of chat content that arises from Stream's infrastructure, systems, or any breach on their side.

You use the chat features at your own risk and acknowledge that real-time messaging inherently involves transmission of data through third-party infrastructure outside our direct control.

Rezonect sends push notifications via Firebase Cloud Messaging and in-app notifications via SignalR. By enabling notifications at the OS level, you consent to receiving alerts about friend activity, emotion updates, Moments, reactions, and messages. You can manage notification preferences at any time in the Settings section of the app.

Our Privacy Policy, which is incorporated into and forms part of these Terms, explains how we collect, use, store, and share your personal data. Please read it carefully.

Rezonect is fully committed to compliance with the General Data Protection Regulation (EU) 2016/679 (GDPR). In accordance with GDPR, you have the right to:

• Request a copy of your data: You can request a portable export of all personal data we hold about you directly from the app (Settings > Account > Request Personal Data Export).
• Delete your account and data: You can permanently delete your account and all associated personal data directly from the app (Settings > Account > Delete Account). Upon deletion, we erase your data in accordance with the retention periods set out in our Privacy Policy and initiate deletion with our third-party processors.
• Rectify, restrict, or object to processing: You may exercise any of your GDPR rights by contacting us or using the in-app tools described in our Privacy Policy.

We process your data only on lawful bases as required by GDPR and do not use your personal data for advertising or profiling for commercial purposes.

All rights, title, and interest in the Rezonect application, including its design, code, branding, logos, and all content created by us, are owned by or licensed to Rezonect. Nothing in these Terms grants you any right to use our trademarks, brand assets, or proprietary materials.

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT.

WE DO NOT WARRANT THAT:

(a) THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS;
(b) THE RESULTS OBTAINED FROM USE OF THE SERVICES WILL BE ACCURATE OR RELIABLE;
(c) ANY DEFECTS IN THE SERVICES WILL BE CORRECTED;
(d) THE SERVICES WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS.

Where applicable law does not permit the exclusion of implied warranties, such exclusions apply only to the maximum extent permitted.

TO THE MAXIMUM EXTENT PERMITTED BY ROMANIAN LAW AND APPLICABLE EUROPEAN UNION LAW, REZONECT AND ITS AFFILIATES, DIRECTORS, EMPLOYEES, AGENTS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR:

(a) ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES;
(b) ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES;
(c) ANY DAMAGES ARISING FROM YOUR INABILITY TO ACCESS OR USE THE SERVICES;
(d) ANY CONDUCT OR CONTENT OF OTHER USERS OF THE SERVICES;
(e) ANY UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR DATA;
(f) ANY FAILURE OR DEFICIENCY OF THIRD-PARTY SERVICES, INCLUDING BUT NOT LIMITED TO GETSTREAM'S CHAT INFRASTRUCTURE, FIREBASE, OR AMPLITUDE.

WHERE APPLICABLE LAW DOES NOT PERMIT SUCH LIMITATIONS, OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED.

You agree to indemnify and hold harmless Rezonect and its affiliates, directors, employees, and agents from any claims, damages, losses, costs, or expenses (including legal fees) arising out of or relating to: (a) your use of the Services; (b) your Content; (c) your violation of these Terms or applicable law; or (d) your violation of any third party's rights.

Rezonect is operated from Romania, a Member State of the European Union (EU). These Terms and any disputes arising out of or in connection with them or the Services shall be governed exclusively by the laws of Romania and applicable European Union law, including but not limited to the General Data Protection Regulation (EU) 2016/679 (GDPR), without regard to conflict of law provisions.

Any legal action or proceedings arising out of or relating to these Terms or the Services must be brought exclusively before the competent courts of Romania. By using the Services, you consent to the exclusive jurisdiction of Romanian courts. Users within the EU retain all rights afforded to them under EU consumer protection and data protection legislation.

We encourage you to contact us first at support@rezonect.com to resolve any dispute informally before initiating legal proceedings. We will endeavour to respond within 30 days.

For users located in the European Union, the European Commission provides an Online Dispute Resolution platform accessible at: https://ec.europa.eu/consumers/odr/

We may update these Terms from time to time. When we make material changes, we will notify you through the app or by email at least 14 days before the changes take effect. Your continued use of the Services after that date constitutes your acceptance of the updated Terms.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
